1. Acceptance of Terms

By accessing or using Trivexano ("the Service"), operated by Smart Technology Investments LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We reserve the right to update these terms at any time, and your continued use constitutes acceptance of any modifications.

2. Description of Service

Trivexano provides HSA (Health Savings Account) triple-tax optimization tools, including contribution optimization, HDHP (High Deductible Health Plan) comparison, investment allocation modeling, Medicare interaction analysis, and long-term HSA growth projections. The Service uses publicly available data from the IRS, CMS, and Department of Labor.

3. Not Financial or Tax Advice

Trivexano is an informational tool and does not constitute financial advice, tax advice, or a recommendation to purchase any specific health plan or investment product. We are not a registered investment advisor, CPA firm, or insurance broker. HSA contribution limits, HDHP thresholds, and Medicare interaction rules change annually. You should consult a qualified tax professional or financial planner before making HSA contribution, investment, or health plan decisions.

4. Intellectual Property

All content, algorithms, optimization models, and data compilations within the Service are the intellectual property of Smart Technology Investments LLC. You may not reverse engineer or extract the triple-tax optimization logic. Reports generated by the Service are licensed to you for personal use only.

5. Acceptable Use

You agree to use the Service only for lawful purposes related to personal HSA planning. You may not use the Service to facilitate tax evasion, generate misleading health plan comparisons for commercial solicitation, or engage in any illegal activity. Automated scraping, credential sharing, and circumvention of rate limits are prohibited.

6. API Usage

Developer API access provides Layer 1 data including HSA contribution limits, HDHP thresholds, catch-up contribution rules, and Medicare Part A enrollment data. Usage is subject to rate limits defined by your subscription tier. Redistribution of raw API data or use in competing products is prohibited.

7. Limitation of Liability

To the maximum extent permitted by law, Smart Technology Investments LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to incorrect contribution calculations, tax penalties from over-contribution, or investment losses. Our total liability shall not exceed the fees you paid in the twelve months preceding the claim.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that HSA limits, HDHP minimums, or Medicare thresholds are current or error-free. IRS rules and CMS guidelines change annually and may be applied retroactively.

9. Arbitration

Any dispute arising from these Terms or the Service shall be resolved by binding arbitration administered by JAMS in Los Angeles County, California. You waive your right to a jury trial and to participate in class action lawsuits. The arbitrator's decision shall be final and binding.

10. Governing Law

These Terms are governed by the laws of the State of California. Any litigation not subject to arbitration shall be brought exclusively in the courts of Los Angeles County, California.
